RE: Insurance Claim



	Robert first off, do not accept all the doctor's words straight off.  You 
will get more then what he predicts depending on how badly you want it.  I 
am a big fan of emotional healing in the sense that once the doctors say 
your healed at less than your original capacity, you through the grace of 
whom ever get more done yourself and with others help.  Get well soon 
Brother.
	As for the other guys insurance or yours, that depends...  On this side of 
the pond it would depend on whether or not you have the funds to pursue the 
other guys insurance company for restitution.  By the way this (other guys 
insurance), I would estimate would be the maximum possible outcome, my 
attorney would agree.  Without representation your are undoubtedly going to 
miss some of the little nooks of laws that exist.  Insurance companies are 
not always privy to things motorcycle.  In my case I am getting something 
called "loss of use" that I had no idea existed.  It is a substantial thing 
as well.
	Verify the terms of representation and if at all possible seek a 
motorcycle specialist.  At the very least, ask a friend for a lawyer they 
have used and would use again and get a referral to, hopefully, someone who 
specializes in motorcycle accidents.

Had a bad time on Thursday - fell off my 500 mile-old ST. I was travelling
through a green traffic light at a crossroads in central London at about
20mph when a taxi pulled straight across my path. I instinctively turned 
and
braked - and of course promptly fell off! At least I managed to avoid a
collision. The bike went for a 15 yard slide - ?1300 ($2000) worth of
damage.

I put my hand down and broke my wrist at the joint with the hand, spent
Easter in hospital having an operation and afterwards was told by the
surgeon that I may only recover 80% of it's previous strength and movement
capability.

 And... I won't be able to ride for nearly 2 months.

Anyway, the purpose of this email is to request help with a dilemma I have
regarding the method of acquiring compensation:

I intend to appoint a legal representative (my separate legal insurance
covers this)

I have two choices:

1. Potential lawyers I have spoken to recommend that they act for me by
claiming against the third party's insurance for all damages (bike,
clothing, personal injury etc.).

2. My insurance broker on the other hand recommends that I claim on my
insurance policy (after all, that is what I pay the premium for). My policy
is fully comprehensive.

I have a witness and am confident that no fault will be attributed to me in
the accident, so I don't expect my no-claims discount will be affected or
that I will have to pay my 'excess'.


Which path is likely to lead to the best level of compensation and is best
generally? Any help or experience of other list members would be very much
welcomed.
