[ST] Inoperative red light
>>> I know in Oregon that there's no provision for running a red light,
even if it's defective. <<<
1) If you are a legally licensed rider operating a legally
registered and insured bike, in any state in the union, the traffic
light is REQUIRED by law to recognize you;... if it does not do so it is
INOPERATIVE by definition. Every state has a procedure to follow when
confronted by an inoperative traffic light,... usually something like
'come to a full stop and proceed when it is safe to do so'.
2) Having said that, you must be willing to take your case to court
and prepared to file an appeal if the judgment is against you.
Prosecutors and courts not only have very limited knowledge of the law
but they couldn't care less. However if you lose the first time, the
judge has made an error in law and your appeal will be sure to win on
that basis. If you are being mugged and want to keep your money, you
have to fight. If you get a ticket and want to keep your money, you
have to fight. Bear in mind that the purpose of our system of justice
is to create income for those who operate the system,... that's why it
came into being and that's why it exists today. If it ever stops
producing that income it will cease to exist forthwith.
